Terms & Conditions

These terms and conditions apply to the Tourist Lens app (hereby referred to as "Application") for mobile devices that was created by xaxo (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device.

Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance. If you use the Application outside of a Wi-Fi area, your mobile network provider's agreement terms still apply, and you accept responsibility for any resulting charges, including roaming data charges if you use the Application outside your home territory without disabling data roaming.

Similarly, it is your responsibility to ensure that your device remains charged; the Service Provider cannot be held responsible if your device runs out of battery and you are unable to access the Service.

Please note that the Application utilizes third-party services that have their own Terms and Conditions:

• Google Play Services
• Google Analytics for Firebase
• Firebase Crashlytics
• Google AdMob
• RevenueCat

The Application incorporates Artificial Intelligence (AI) technologies, including Google Gemini and TFLite, to provide features such as landmark identification and conversational guides. Please be aware that AI-generated content may be inaccurate, incomplete, or biased (commonly referred to as "hallucinations"). The Application is intended for informational and entertainment purposes only. The Service Provider accepts no liability for any loss, direct or indirect, resulting from relying entirely on the navigation, mapping, or historical data provided by the Application. You are solely responsible for your own safety and must follow local traffic laws and signage at all times.

Subscription Tiers, Consumables & Usage Limits

The Application operates on a flexible monetization model:

1. Traveler (Guest/Anonymous): Free access to basic features with lifetime identification limits and periodic allowances.
2. Tourist Pro & Guide Pro (Time-Bucket Passes & Subscriptions): Provides unlimited scanning, deep historical narrations, and advanced trip planner features.
3. Audio Credits & Consumable Packs (Kokoro Audio Narrations): Users may purchase consumable credit packs or earn credits by watching optional rewarded video advertisements. Consumable credits are linked to your account and deducted per narration generation.

Refunds for Scans & Kokoro Credits: A scan or narration credit is spent at the start of the AI generation, before you see the result. If that specific generation fails due to a technical error on our side (an AI service error, timeout, or network failure), the spent credit is automatically returned to your balance, provided you report the failure within 5 minutes of the attempt. Outside that window, or for any reason other than a reported technical failure, the spend is final and non-refundable. To prevent abuse, no more than 2 such refunds may be claimed per 24-hour period.

Rewarded-Ad Failures: If you choose to watch a rewarded video advertisement to earn credits, delivery of the ad is controlled by our third-party ad provider (Google AdMob) and is not guaranteed. If an ad fails to load or does not finish playing, no credit is deducted and none is granted — you lose nothing. If you complete a rewarded ad in full but the corresponding credit does not appear in your balance, contact us at tourist.ai.guide@gmail.com with the approximate date and time of the ad view so we can investigate and manually credit your account if warranted.

Passe de Viagem (Time-Bucket Passes): Purchasing a pass adds a specific duration (e.g., 24 hours, 72 hours, 7 days) to your account. Access expires automatically once the time bucket is exhausted. All purchases are final and non-refundable once the pass has been activated.

Battery & Hardware Performance

The Application includes a Battery Saver mode. When active, sensor polling frequency and visual animations may be reduced, which might slightly affect AR precision. The Service Provider is not liable for minor discrepancies in AR pathfinding or content alignment when Battery Saver mode is active.

Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. These terms and conditions are effective as of 2026-09-15.

Governing Law

These terms are governed by the laws of Spain. Any dispute arising from the use of the Application shall be subject to the courts of Spain, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
